1. Introduction

This Privacy Policy ("Policy") describes how Industries Design LLC ("Industries Design," "Agency," "we," "us," or "our") collects, uses, and protects information when you interact with our website, services, and materials. Our services include website design, development, and hosting, as well as custom software, custom web and mobile applications, automation systems, internal business tools, managed applications, integrations, and related services (collectively, the "Services").

By using our Services, you acknowledge you have read this Policy and agree to its terms. If you do not agree, please do not use our Services.

Note: This Policy describes our practices as an independent company. Where we build, host, or operate websites, applications, or automation systems for Clients, we act as a "Data Processor" on their behalf. In those cases, our Client (not Industries Design) is responsible for the privacy practices governing their end-users' data. See Section 2.2 below.

2. Information We Collect

We collect information in two contexts:

2.1. Data We Collect About You (When You Contact Us)

When you visit our website, request a demo, sign up for a service, or communicate with us, we may collect:

• Information you provide directly: Name, email address, phone number, company name, job title, website URL, and any other information you include in your messages.
• Automatic information: IP address, browser type, operating system, pages visited, time spent on pages, and referral source. We collect this through cookies, log files, and similar technologies.
• Information from public sources: When building a free demo, we may research your business using publicly available information (e.g., your website, Google Maps, social media) to understand your industry and create a relevant example.

2.2. Data We Process on Behalf of Our Clients

When we build, host, or manage a website, custom application, internal tool, managed application, or automation system for a Client, we may have access to their end-users' or business data (e.g., leads collected through forms, records synchronized between a Client's systems, messages processed by an automation, data stored in a Client's application, or content posted by end users through a Client's marketplace, community, or other interactive features). In this case:

• The Client is the "Data Controller." The Client is responsible for compliance with privacy laws and informing their end-users how their data is used, including data collected or processed through any application or automation system we build or operate for them.
• We are the "Data Processor." We only process data as instructed by the Client and as necessary to provide hosting, development, maintenance, and technical services.
• Third-party platforms may also process this data. Automation systems and integrations pass data through the third-party platforms the Client chooses to connect (e.g., CRMs, messaging tools, AI providers). Those platforms' own privacy policies govern their handling of that data, and we are not responsible for their practices.
• Our obligations are documented separately. Client-specific data handling is governed by our Terms of Service (including its Data Processing section) and any applicable Statement of Work (SOW).

3. How We Use Your Information

We use information we collect for these purposes:

• Providing and managing our Services: To build, maintain, host, operate, and support your website, application, automation system, and account.
• Communication: To respond to inquiries, send transactional emails (e.g., billing, support), and contact you about updates or promotional offerings.
• Website analytics and improvement: To understand how people use our website and improve our Services. We use analytics tools such as Google Analytics and PostHog for this.
• Aggregated research and AI development: To develop and improve our products and AI tools, we may analyze anonymized, aggregated data. This data is stripped of all personal identifiers and cannot be used to identify you. Your specific business information is never included.
• Security and compliance: To maintain security, prevent fraud, enforce our agreements, and comply with legal obligations.

4. How We Share Your Information

We do not sell your personal information to data brokers or third-party marketers. Note that the advertising and analytics pixels described in Section 5 may be considered "sharing" under certain state privacy laws; you can control these through your browser and cookie settings. Here's how we may share your information:

• Service providers: We share information with third parties who help us operate our business (e.g., hosting providers, email services, payment processors, analytics providers, AI/model providers used in the delivery of a service). These vendors are contractually required to protect your information.
• Platforms you connect: If your Services include integrations or automation systems, data flows to the third-party platforms you choose to connect. Their privacy policies govern their handling of that data.
• Legal compliance: If required by law, court order, or government request, or to protect our rights, property, or safety, we may disclose information to comply with legal obligations.
• Business transfers: If Industries Design is acquired or merged with another company, information may be transferred as part of that transaction (but the buyer must continue to honor this Privacy Policy).

5. Cookies and Tracking Technologies

We use cookies, tracking pixels, and similar technologies (including but not limited to Meta Pixel, TikTok Pixel, Google Analytics, and PostHog) to remember your preferences, analyze site usage, measure performance, and support advertising.

• First-party cookies: Set by Industries Design to improve your experience.
• Analytics & advertising: We use Google Analytics and similar tools. You can opt-out of Google Analytics by installing the browser add-on.

You can control cookies through your browser settings, though some Services may not function properly if cookies are disabled.

6. Data Retention

We retain information for as long as necessary to provide our Services, comply with legal obligations, enforce our agreements, or resolve disputes.

• Prospect data: Generally kept for up to 2 years, or for as long as reasonably necessary for legitimate business purposes, unless you request deletion.
• Client account data: Retained during the active subscription. After cancellation, we may retain content and application data for up to 30 days as a courtesy, but we are not obligated to retain any data after termination and may delete it at any time; it may be permanently deleted after that period unless you purchase a buyout or arrange otherwise. You are solely responsible for exporting and independently backing up any data you wish to keep before your subscription ends.
• Logs and analytics: Retained for up to 90 days for security and troubleshooting purposes.

7. Your Privacy Rights

Our Services are directed to businesses in the United States. Depending on where you live, you may have certain rights regarding your personal information under laws such as the California Consumer Privacy Act (CCPA/CPRA) and other U.S. state privacy laws:

• Right to access / know: You can request a copy of the personal information we have about you.
• Right to correct: You can request that we correct inaccurate information.
• Right to delete: You can request deletion of your data, subject to legal or business requirements to retain it.
• Right to non-discrimination: We will not discriminate against you for exercising your privacy rights.

We do not sell personal information or share it for cross-context behavioral advertising as those terms are defined under applicable state privacy laws, except to the extent that the use of standard advertising pixels described in Section 5 may be considered "sharing" — which you can control through your browser and cookie settings.

To submit a privacy request, email us at privacy@industriesdesign.com with a clear description of your request. We will respond within the timeframe required by applicable law (generally within 30–45 days) and may ask for verification of your identity.

Note: If you're requesting data that we process on behalf of a Client (for example, data submitted through a Client's website, application, or automation system), we'll direct you to contact that Client directly, as they are the Data Controller for that information.

8. Data Security

We implement industry-standard security measures including:

• SSL encryption for data in transit
• Secure data storage with access controls
• Automated backups (frequency varies by plan)
• Regular security monitoring and updates
• Firewalls and intrusion detection systems

However, no security system is perfect. No method of transmission or storage is 100% secure, and we cannot and do not guarantee absolute security. To the fullest extent permitted by law, we disclaim any liability for unauthorized access, hacking, data loss, or other breaches beyond our reasonable control. You use our Services at your own risk, and you are responsible for maintaining independent backups of your business-critical data.

9. Third-Party Links and Services

Our website and the products we build may link to, embed, integrate with, or depend on third-party sites and services (e.g., payment processors, CRMs, messaging platforms, AI providers, hosting infrastructure). We are not responsible for the privacy practices, security, or content of those third parties. Please review their privacy policies independently.

Where a Client's website or application processes payments, those payments are handled by the Client's own payment processor (e.g., Stripe) under that processor's privacy policy and terms. We do not receive, store, or process cardholder data, and payment information submitted through a Client's platform goes directly to the applicable payment processor.

10. International Data Transfers

By using our Services, you consent to the transfer and processing of your information in the United States, which may have different privacy laws than your home country.

11. Children's Privacy

Our Services are not directed to individuals under 16. We do not knowingly collect personal information from children. If we learn that we have collected such information, we will promptly delete it.

12. Do Not Track Signals

Some browsers include a "Do Not Track" feature. Our Services do not currently honor Do Not Track requests, but you can control cookies through your browser settings.

13. Changes to This Privacy Policy

We may update this Policy from time to time. The updated version will be posted at https://industriesdesign.com/privacy-policy with an updated "Last Updated" date. Your continued use of our Services after changes are posted means you accept the new Policy.

14. Dispute Resolution by Binding Arbitration

This section matches our Terms of Service. Any disputes related to this Privacy Policy will be resolved through binding arbitration, not court litigation.

• Binding Arbitration: Disputes will be arbitrated in Dover, Delaware under American Arbitration Association (AAA) Commercial Arbitration Rules.
• Class Action Waiver: You and Industries Design agree to bring claims only in individual capacity, not as part of a class action.
• Time Limit: Any claim must be filed within one (1) year after it accrues, to the fullest extent permitted by law.
• Governing Law: This Policy is governed by Delaware law.
