1. Introduction
This Privacy Policy ("Policy") describes how Industries Design LLC ("Industries Design," "Agency," "we," "us," or "our") collects, uses, and protects information when you interact with our website, services, and materials.
By using our Services, you acknowledge you have read this Policy and agree to its terms. If you do not agree, please do not use our Services.
Note: This Policy describes our practices as an independent company. Where we build and host websites for Clients, we act as a "Data Processor" on their behalf. In those cases, our Client (not Industries Design) is responsible for the privacy practices governing their end-users' data. See Section 2.2 below.
2. Information We Collect
We collect information in two contexts:
2.1. Data We Collect About You (When You Contact Us)
When you visit our website, request a demo, sign up for a service, or communicate with us, we may collect:
- Information you provide directly: Name, email address, phone number, company name, job title, website URL, and any other information you include in your messages.
- Automatic information: IP address, browser type, operating system, pages visited, time spent on pages, and referral source. We collect this through cookies, log files, and similar technologies.
- Information from public sources: When building a free demo, we may research your business using publicly available information (e.g., your website, Google Maps, social media) to understand your industry and create a relevant example.
2.2. Data We Process on Behalf of Our Clients
When we build or manage a website for a Client, we may have access to their end-users' data (e.g., leads collected through forms). In this case:
- The Client is the "Data Controller." The Client is responsible for compliance with privacy laws and informing their end-users how their data is used.
- We are the "Data Processor." We only process data as instructed by the Client and as necessary to provide hosting and technical services.
- Our obligations are documented separately. Client-specific data handling is governed by a separate Master Service Agreement (MSA) or Statement of Work (SOW).
3. How We Use Your Information
We use information we collect for these purposes:
- Providing and managing our Services: To build, maintain, and support your website and account.
- Communication: To respond to inquiries, send transactional emails (e.g., billing, support), and contact you about updates or promotional offerings.
- Website analytics and improvement: To understand how people use our website and improve our Services. We use Google Analytics for this.
- Aggregated research and AI development: To develop and improve our products and AI tools, we may analyze anonymized, aggregated data. This data is stripped of all personal identifiers and cannot be used to identify you. Your specific business information is never included.
- Security and compliance: To maintain security, prevent fraud, and comply with legal obligations.
4. How We Share Your Information
We do not sell your personal information. Here's how we may share it:
- Service providers: We share information with third parties who help us operate our business (e.g., hosting providers, email services, payment processors). These vendors are contractually required to protect your information.
- Legal compliance: If required by law, court order, or government request, we may disclose information to comply with legal obligations.
- Business transfers: If Industries Design is acquired or merged with another company, information may be transferred as part of that transaction (but the buyer must continue to honor this Privacy Policy).
5. Cookies and Tracking Technologies
We use cookies and similar technologies to remember your preferences and analyze site usage.
- First-party cookies: Set by Industries Design to improve your experience.
- Analytics: We use Google Analytics. You can opt-out of Google Analytics by installing the browser add-on.

6. Data Retention
We retain information for as long as necessary to provide our Services, comply with legal obligations, or resolve disputes.
- Prospect data: Kept for up to 2 years unless you request deletion.
- Client account data: Retained during the active subscription and for 30 days after cancellation (to allow data recovery). Content data is then permanently deleted unless you purchase a buyout or arrange otherwise.
- Logs and analytics: Retained for up to 90 days for security and troubleshooting purposes.
7. Your Privacy Rights
Depending on where you live, you may have certain rights regarding your personal information:
- Right to access: You can request a copy of the personal information we have about you.
- Right to correct: You can request that we correct inaccurate information.
- Right to delete: You can request deletion of your data, subject to legal or business requirements to retain it.

Note: If you're requesting data that we process on behalf of a Client, we'll direct you to contact that Client directly.

- Regular security monitoring and updates
- Firewalls and intrusion detection systems
However, no security system is perfect. While we strive to protect your information, we cannot guarantee absolute security. You use our Services at your own risk.

Our website may link to third-party sites (e.g., payment processors, integrations). We are not responsible for the privacy practices of those sites. Please review their privacy policies independently.
10. International Data Transfers

This section matches our Terms of Service. Any disputes related to this Privacy Policy will be resolved through binding arbitration, not court litigation.
- Binding Arbitration: Disputes will be arbitrated in Dover, Delaware under American Arbitration Association (AAA) Commercial Arbitration Rules.
- Class Action Waiver: You and Industries Design agree to bring claims only in individual capacity, not as part of a class action.
- Governing Law: This Policy is governed by Delaware law.
